Trump supports Habba for the American lawyer while the judges replace her in New Jersey

President Donald Trump doubles his appointment of Alina Habba after the federal judges of New Jersey refused to extend his warrant as an American interim lawyer, and rather chose to replace it with another prosecutor, which the Doj then dismissed.

The unusual event chain has led to the confusion that will become the next lawyer between the United States, in the New Jersey district, while the 120-day Habba’s mandate is expected to expire this week.

A White House spokesperson said in a statement provided to Fox News Digital that Trump supports Habba becoming permanent lawyer, a position that requires confirmation from the Senate.

“President Trump has fully confidence in Alina Habba, whose work as an American lawyer for the New Jersey district made the Garden State and the safer nation,” said White House spokesman Harrison Fields. “The Trump administration is impatiently awaiting its final confirmation in the American Senate and will work tirelessly to ensure that the inhabitants of New Jersey are well represented.”

But Habba’s vote in the Senate does not seem to happen anytime soon, if at all. The two Democratic Senators of New Jersey, Cory Booker and Andy Kim, are currently blocking the appointment of Habba through the tradition of the “Blue Slip” Senate, and a person familiar with the process said that the Senate had not received any equipment necessary to examine its appointment in any case.

Meanwhile, arcana laws surrounding authority to fill federal vacant posts have become relevant.

Trump appointed Habba as an American temporary lawyer in March, but this mandate expires on Friday, according to the Ministry of Justice. The statutes indicate that federal judges have the power to extend the mandate of an acting American prosecutor or to vote to replace this person.

The judges of the district court of New Jersey, most of whom were appointed by Democratic presidents, met in camera on Monday and chose to replace Habba with his best assistant, Desiree Grace, an MJ prosecutor in career since 2016. Grace made the ranks pass to become head of the criminal division in New Jersey before becoming the N ° 2 of Habba in April.

However, the Attorney General Pam Bondi allegedly alleged that the judges violate Trump’s authority to appoint American lawyers by voting to replace Habba. Bondi said that she “deleted” the grace in response to the actions of the judges.

“(Habba) did an excellent job to secure the NJ,” Bondi said in a statement. “Nevertheless, the political judges refused to allow her to continue his post, replacing Alina by the first assistant. Consequently, the first American prosecutor of New Jersey has just been removed.”

Grace could not be joined to comment. An anonymous source of knowledge of the case told the New York Times that Grace had received an e-mail on Tuesday informing him that she had been dismissed.

A Habba spokesperson told Fox News Digital that Habba was still the American interim lawyer until Friday. But the tension between the GM and the judges leaves the question of which will assume the role on Saturday.

Booker said that the dismissal of an American lawyer appointed by the court was part of a “diagram” of the Doj flouting the law.

“The dismissal of a career civil servant, legally appointed by the Court, is another blatant attempt to intimidate anyone who does not agree with them and to undermine judicial independence,” wrote Booker on X.

Booker is one of the criticisms that judged Habba not qualified for the position. Habba, who was a legal spokesperson for Trump and personal defense lawyer during his criminal proceedings, had no experience as a prosecutor before Trump appointed her as the main prosecutor in New Jersey.

After taking the post, Habba was accused of politicizing the role after pleading in the process of turning the New Jersey “Red”, and she pulled a rare reprimand of a judge for having ordered the arrest of the Democratic Mayor of Newark, then quickly rejecting the accusations.

But the leaders of Trump and Doj are held firmly by Habba. The Trump administration has found a bypass solution in the North District of New York when John Sarcone’s mandate as an American lawyer recently expired there, but it is not clear if a similar option is available for Habba.

Anne Joseph O’Connell, professor of Stanford Law School, wrote on Bluesky that she believed that Trump had the power to dismiss Grace and perhaps reshuffle Habba to serve another temporary term.

“The question is now, they will name Habba to a new 120-day acting prosecutor meeting or will they turn to the law on vacant posts and name a different person as an American lawyer,” wrote O’Connell.
