“As the special council office is responsible for ensuring that federal employees do not carry out a partisan political activity under the guise of their federal employment, you are well located to determine if Smith has broken the law,” wrote the republican of Arkansas.

“Many Smith’s legal actions seem to have no justification, except for an attempt to affect the results of the 2024 elections-actions that violate federal law,” he continued.

Smith was operated by former Attorney General Merrick Garland to investigate the allegations that Trump sought to cancel the results of the 2020 elections, and then investigated the processing of classified documents that were discovered during a raid at the Trump Mar-A-Lago complex.

Cotton listed four cases during Smith’s mandate where he accused that the prosecutor has accelerated the dates of the trial and published “without legitimate” information.

In an example, Cotton accused Smith of accelerating the date of the trial and the selection of the jury for his case against Trump concerning his indictment of August 2023 which was part of his electoral investigation in 2020.

This indictment included four accusations against the president, including the conspiracy to defraud the United States, the obstruction of an official procedure, the conspiracy to hinder an official procedure and the plot against rights.

Cotton argued that, generally, defendants have more than two years to prepare for this type of trial, and noted that the jury selection period was scheduled two weeks before the Iowa caucus in 2024.

He also charged that Smith has circumvented the normal call process and “failed to express a legitimate reason”, the court should grant his request when Smith asked for a trial before the next day of the poll, wanted an accelerated examination of the Court of Appeal, then filed a request to the Supreme Court of December 2023.

Cotton accused Smith of having violated the “60 -day rule” of the Ministry of Justice, which prevents proceedings from taking projects that could influence a future election. This accusation stems from Smith’s decision to file a dissertation following the Supreme Court’s decision concerning presidential immunity, which was granted on September 26, 2024, just over a month of the elections.

And this brief, noted the cotton, exceeded the length normally authorized four times and included the testimony of the great jury “generally kept secret at this stage in other procedures”.

“These actions were not standard, necessary or justified – unless Smith’s real objective is to influence the elections,” said Cotton. “In fact, throughout the mandate of the Smith Special Advocate, he regularly used eccentric and aggressive legal theories to continue the Republican candidate for the presidency. I would add that President Biden also called in the elections for President Trump to be” locked up “.”

“President Trump, of course, defeated Joe Biden, Jack Smith, all the Democrats who armed the law against him, but the surprising victory of President Trump does not excuse Smith of his illegal electoral interference,” he continued. “I therefore ask the office of special advice to investigate if Jack Smith or members of his team acted illegally for political purposes.”

Fox News Digital contacted Smith but did not immediately hear.
