The Republican proposes to authorize the National Guard for the application of immigration

First of all on the fox: New legislation aims to codify the president’s authority to deploy National guard Units for the application of immigration, as part of a broader effort to suppress illegal immigration and stiffen sanctions for those who attack immigration agents.

The bill, written by representative Pat Harrigan, RN.C., would allow the president to federate and deploy the National Guard when the States refuse to cooperate, as the governor. Gavin Newsom in California. He also stipulates that those who attacked immigration agents receive the death penalty or life imprisonment if an officer is killed.

Under the current law, the Comitatus posse law prohibits the use of federal military forces for national purposes of application of the law. However, the Guard Act offers a closely personalized exception allowing the National Guard – under the federal orders of title 10 or 32 – to be used “exclusively” to apply the Federal Immigration Act. This includes the apprehension and the detention of people in the United States illegally, as well as the execution of dismissal orders and the conduct of border security operations.

The proposal comes in the midst of increasing republican frustration with what is called “sanctuary” jurisdictions This limit of cooperation with federal immigration application agencies – and after a descent of immigration and customs application (ICE) in Los Angeles led to generalized riots.

Trump sent the National Guard to respond to anti-glossy demonstrations and then deployed American navies.

California continued the deployment, but so far, the courts have allowed Trump to keep the custody control.

“The Guard Act clearly indicates: when state leaders and local refuse to apply the federal immigration law, the president has the authority – and the responsibility – to act,” said Harrigan.

In addition to the capital penalty for having killed an immigration agent, the bill requires a minimum of five years in prison and 10 years if the assault causes bodily injuries.

The proposed sanctions reflect similar laws which protect federal laws from the application of laws but extend explicit coverage to the staff of the immigration application.
