Virginia Ag publishes a report on the alleged violations of the Fairfax prosecutor

Virginia’s prosecutor Jason Miyares released a 33 pages report Friday, the chronicle of what he said is systemic violations of public policy and confidence by the lawyer for the county of Fairfax, Steve Descano, in particular in a major case involving a sexual offender who identified as transgender.
Descano, an elected democrat, was criticized for the discretionary power of allegedly lax proceedings, especially in cases involving transgender people and, more recently, a recurrence by a recurrence at Fair Oaks Mall near John Foster Dulles International Airport.

Descano was also criticized on the management by Fairfax of the rape of a jogger on the W & OD Trail – a popular path connecting Purcellville and Washington, DC – after the suspect arrested was revealed to have a long history of sexual assault and was recently released from the guard.
In 2022, the police chief in Herndon – where the alleged assault also took place – said to Fox-5 Descano’s office has downgraded a criminal indictment to an offense in a matter relating to the man who was going to suffocate one of their officers.
“Justice is not optional,” Miyares said a republican on Friday. “And our laws are not suggestions.”
“The lawyer for Fairfax Commonwealth, Steve Descano, betrayed the rule of law and the very people he has sworn to protect, transforming the discretion of proceedings in deliberate and armed incompetence,” said Miyares, who presents himself for a re -election against the former del. Jerrauld “Jay” Jones, D-Norfolk.
Miyares said that Descano was sworn in to maintain the law and protect the victims of Fairfax County – who houses George Washington, George Mason, Richard Bland Lee and other historic personalities.

In his report, Miyares particularly targeted Descano policy prohibiting the application of certain mandatory minimum sentences for serious crimes, and relaxing or ignoring the requirements for cash guarantee for repeat offenders – and has presented several cases.
A case involved the sex offender condemned Richard Cox, who recently identified as transgender in an indecent exposure case. Cox repeated entries with the police in Arlington and Fairfax dating from 1992, when Cox was accused of “indecent freedoms with a child”.
In 2006, COX was excluded from a public library after accessing the Internet without authorization and lingering in the children’s section with a laptop. Later, the police seized a Van Cox computer lived and found a “CP” labeled file which contained juvenile pornography.
Quick advance of Descano’s mandate: While Cox was approaching the end of probation in 2023, a probation agent warned Cox to continue to follow probation orders and avoid libraries, community centers and similar places.
COX then quoted “instability in residence” in a dispute with the probation agent concerning compliance with the registration requirements of sex offenders. COX also told the officer that evolution of gender presentation could complicate surveillance and create risks under probation rules.
In a subsequent judicial file, COX identified itself as transgender and accused the victim of “anti-trans discrimination”.

Descano’s office then refused to participate in the accusation and the prosecution of modesty was then abandoned.
Miyares noted that the gymnasium is located in the same building as an attraction of interior playground for children, and that the flattering less than 100 feet of such an installation violates the terms of Cox.
While Cox was imprisoned in the neighboring county of Arlington, Miyares criticized Descano for having omitted to prosecute Cox in the appropriate jurisdiction and shared several quotes from local democratic legislators wondering how the COX affair took place.
“If my family was in a locker room, I would not want them to be exposed to this kind of situation … And I think we have a duty to make sure that people are not exposed, especially on a regular basis, for the good of God,” said the head of the majority of the Senate of Virginia, Scott Surovell, D-Mount Vernon.

With regard to the alleged violations of the Constitution of the State, Miyares noted that Descano had perhaps violated article I of article 8a, concerning the refusal of the victims of crimes all the rights guaranteed in law.
