A federal judge of Idaho judged that a public charter school had violated the rights of the first amendment of a church when he canceled a lease which allowed the church to hold the services of Sunday in his gymnasium.
The decision of the chief judge of the American district court, David Nye Idaho Education News.
The website said that when the lease was canceled last year, SAGE International asked about $ 15 million in bonds to finance construction improvements via the Idaho Housing and Finance Association (IHFA). The lawyers of the state’s surety authority then pointed out the church lease as a potential violation of the Blaine amendment of Idaho, which prevents religious organizations from receiving taxpayers, he added.
Nye would have written in his decision that the concern was a “judgment time”, as the Bible Church of the Truth family would have “only accidentally benefited from improved installations of obligations”, without funds which were directly given to them.

“The motivations of IHFA and Sage to end the lease of the family of truth, whether reasonable or not, were still a violation of the constitutional rights of the family of truth,” Nye also said, according to Idaho Education News.
The website indicated that a lawyer representing the church argued that the use of the Blaine amendment to end the lease dates back to the infirm of the free exercise, the establishment and the clauses of freedom of expression of the first amendment.
Nye agreed with each complaints from the first amendment, writing in his decision that the decision to cancel the lease of the Church “actually stifled” his religious discourse, Idaho Education News reported.
“We are satisfied with this result,” said Idaho’s prosecutor General Raúl Labrador, whose office intervened in the case, Idaho Education News told a spokesperson. “Government agencies cannot discriminate religious organizations simply because they are religious. Truth Family Bible Church deserved the same treatment as any secular group, and we are happy that the Court has recognized it.”

An IHFA spokesman told Idaho Education News that: “We welcome the legal clarity that the court’s decision provides, helping to guarantee that this type of problem does not arise in the future.”
On his website, Truth Family Bible Church describes himself as a “new church factory in Middleton, Idaho”.
“It started as a home biblical study that met for several years. As we started to grow, the Lord led us to speak of the planting of a new church because most of the participants were part of various churches of the county of Ada,” said the Church. “Our goal is to faithfully serve the Word of God as a light for our community and the world, declaring that Christ is the Lord of all.”
