The federal judge prevents Trump’s administrator from retaining transport funds

On Thursday, a federal judge of Rhode Island published a preliminary injunction, preventing the Trump administration from refusing federal transport funds to the states that do not cooperate with the authorities of the application of immigration.
Twenty States led by Democrats have brought legal action against the administration of President Donald Trump, contesting a new policy of the Ministry of Transport (DOT) of refusal or dismissal of federal funding to a government or a local government which does not comply immigration application politicians.
During the first day of Trump’s mandate, he published a radical decree which would refuse federal funds to “so-called sanctuar jurisdictions”.
The judge of the American district court John J. McConnell Jr. published on Thursday the preliminary injunction against the efforts of the Trump administration, affirming that it is “unconstitutional and / or illegal” because it violates the law on administrative procedure.

McConnell also said that the Trump administration’s action was ultra vires – or made beyond its legal authority – and exceeds the powers of the congress under the expense clause.
Under the preliminary injunction, the Trump administration is “prohibited to implement or apply the condition of application of immigration as indicated in the Duffy directive,” wrote McConnell.
He also declared that defendants are “prohibited from retaining or ending federal funding according to the condition of application of immigration, as indicated in the Duffy directive in the absence of specific statutory authorization”.

“Defenders are prohibited from taking unfavorable measures against any state entity or local jurisdiction, including preventing it from receiving or making it unacceptable to federal funding, on the basis of the condition of application of immigration, in the absence of specific statutory authorization,” continued the decision. “The Court prohibits and prohibits any attempt to implement the condition of application of immigration, and all the actions of the defendants to implement or apply the condition of application of immigration.”
Fox News Digital contacted the White House to comment on the question.

More recently, Duffy directed his comments to California officials who have moved away from the application of immigration while riots and demonstrations continue to have fun in places like Los Angeles.
Duffy suggested that political leaders work better with the Trump administration.
“The USDOT will not finance the actors of the Voyou State who refuse to cooperate with the Federal Immigration Application,” said Duffy on Monday. “And in the cities that are held while rioters destroy transport infrastructure – do not expect a red penny either.”
Duffy said in April that federal subsidies are accompanied by the obligation to respect the federal law.

“This should not be controversial-apply our immigration rules, put an end to the anti-American DEI policies and protect freedom of expression. These values reflect the priorities of the American people, and I take measures to ensure compliance,” he said.
