On Monday, a judge temporarily prevented the Trump administration from managing on certain MEDICAIDS funds from Planned Parenthood after the Congress and President Donald Trump agreed to partially finance the non -profit organization thanks to the adoption of the One Big Beautiful Bill law.

Judge Indira Talwani of the Massachusetts District District Court declared in his order in part a preliminary injunction according to which the bill punishes the Planned Parenthood member organizations unconstitutionally which do not provide abortions.

The injunction will risk “at most minimal of damage – financial or otherwise” to the Trump administration while the trial occurs, wrote Talwani, one named by Obama.

The judge’s order seems to be applied to certain Planned Parenthood installations, but not all. The non -profit organization declared in a statement that he considered Talwani’s order as a partial victory and remained “hope” that the judge would take new judicial measures in progress.

“It’s not over,” said the organization. “Although we are grateful that the court has recognized the damage caused by this law, we are disappointed that not all members have obtained the necessary reparation.”

The Talwani ordinance was born from a trial brought by Planned Parenthood, the largest supplier of abortion in the country, on the One Big Beautiful Bill law, a bill on the massive budget which adopted the congress this month without democratic support. Trump signed the bill on July 4.

A provision of the bill has stripped the funding of Medicaid of Planned Parenthood, which, according to the association, could force it to close approximately 200 of its 600 facilities and to deprive around half of its customers, more than a million people, services that do not include abortion.

Planned Parenthood lawyers noted in court documents that Medicaid does not generally cover abortion.

Lawyers have argued that the bill would cause cancer and sexually transmitted infections not to be detected, especially for low -income people, and that more unexpected pregnancies would occur due to a lack of access to contraception. They said that the consequences of loss of funding from Medicaid “will be serious”.

The lawyers of the Ministry of Justice (DoJ) had previously supported in court documents that the objective of the budgetary provision was to cease “federal subsidies for a great abortion” by freezing the federal funds for certain beneficiaries of Medicaid which provide abortions. The weakening of Planned Parenthood was one of the main priorities of the pro-life movement since the Supreme Court canceled ROE v. Wade.

Talwani granted a temporary prohibition order two weeks ago in favor of Planned Parenthood. The judge initially proposed any explanation of his decision, a decision which led to a generalized reaction among the Republicans who described it as a term. A few days later, Talwani offered more context in a subsequent order.

The preliminary injunction will partially leave the break on the indefinite funding of Planned Parenthood, but the Trump administration is likely to appeal the order of the American Court of Appeal for the first circuit.

The judge noted that his injunction applied to the Planned Parenthood entities which do not provide abortion services or receive no less than $ 800,000 in annual Medicaid reimbursements.

The MJ lawyers had already argued in court that blocking a measure which had been adopted by the congress and signed by the president was an extraordinary and unjustified decision.

“Beyond the futility of complaints on merits, Planned Parenthood does not show irreparable imminent damage to justify an injunction, indicating only conventional repairable economic injuries and potential damage that is not relevant to patients, who are not third parties before this court,” wrote MJ lawyers.
