The federal judge blocks the deportation of Abrego Garcia until October

A federal judge from Maryland on Wednesday rendered an order of the court preventing the Trump administration from deporting Kilmar Abrego Garcia from the United States until October, paving the way for new judicial clashes with the government after being taken to immigration and customs custody earlier this week.

US District Judge Paula Xinis extended a temporary ban on Wednesday that she made earlier this week, which obliges Abrego Garcia to keep in the United States Continental – and less than 200 miles from the Greenbelt court, Maryland – until she can consider the emergency request filed by her lawyers during a proof audience.

It also set on October 6 when the date of the hearing takes place, which the two parties accepted and declared that it would govern the emergency request within 30 days.

Xinis’ update maintains Abrego Garcia in the United States for at least five more weeks, blocking the Trump administration, for the moment, to deport it to a third country like Uganda.

This comes after his lawyers made a request for an emergency habeas on Monday to keep Abrego Garcia in the United States for the moment until his immigration case can take place via the appropriate channels, guaranteeing regular procedure protections – including the right to a reasonable maintenance of fear – before being returned to a third country.

ICE officials informed Abrego Garcia’s lawyers at the end of last week that they had planned to stop it this week and deport it on Wednesday in Uganda. The Eastern African country has concluded an agreement with the United States earlier this month to accept certain expelled migrants, although the details of the arrangement were not immediately clear.

The prosecutor of the Ministry of Justice, Drew Ensign, told judge Xinis on Wednesday that the Trump administration had opposed the court extending the temporary ban order, although he confirmed in response to his questions that they would voluntarily comply.

“Your customers are absolutely prohibited at this stage of withdrawing Mr. Abrego Garcia from the continental United States,” Xinis said in Ensign on Monday, emitting the now extensive emergency order.

Also on Wednesday, ABREGO GARCIA lawyers told Xinis that they had filed an emergency request to reopen his immigration affair to ask for asylum.

This request is outside the jurisdiction of Xinis and was filed Tuesday before an immigration court in Baltimore.

Xinis had previously quoted concerns concerning the absence of a known offer from Uganda detailing which protections or freedoms that Béo Garcia would have in Uganda, compared to the information provided by the government of Costa Rica, which had provided written insurance that Grego Garcia would freely live in the country and would not be refuted, or reddeaned, in El Salvador.

Managers of the Ministry of Justice had offered Abrego Garcia the possibility of being moved to Costa Rica last week, as part of a advocacy agreement in exchange for obtaining his guilty plea for criminal accusations linked to human smuggling in Tennessee. He refused.
