The American Department of Education said Thursday that it had revealed that the public schools of Denver had violated title IX, which prohibits discrimination based on sex in education, by establishing bathrooms entirely in the genre and allowing students to use bathrooms that correspond to their gender identity rather than their biological sex.

The office of the Department for Civil Rights opened an investigation in January, shortly after the return of President Donald Trump to the White House, to Denver’s East High School after the school district converted the bathroom of a toilet girl entirely to the genre while leaving another bathroom on the same floor just for boys.

The district said that the change had been made after a process led by students and that the bathroom was 12 feet high around the toilet for confidentiality and security.

A second restaurant entirely in the genre was later on the same floor, which, according to the district, was done to respond to injustice concerns. The district said at the time that students would also continue to have access to specific gender and toilet bathrooms.

The federal government said it had sent a proposed resolution to the district, which includes four conditions to which it should agree in the next 10 days to resolve the issue and avoid dealing with the risk of “imminent application action”.

“Denver’s public schools have violated title IX and its implementation regulations by converting a catering room separated by the designated sex for the girls of the High School East into an installation ‘` all kinds” and by allowing students to use the intimate installations of the high school on the basis of their “gender identity” rather than their biological sex “, said in a Craig declaration.

“Consequently, the district creates a hostile environment for its students by endangering their security, their privacy and their dignity while refusing them access to educational activities and equal opportunities,” he continued. “Denver is free to give birth to an ideology of self-defective gender, but it is not free to accept the federal funds of taxpayers and to harm its students in violation of the title IX.

The proposed resolution would oblige the district to rethink the bathrooms entirely to the gender to the multi-bar toilets designed by sex, to extinguish policies or advice allowing students to access bathrooms according to gender identity rather than biological sex and to adopt “definitions based on biology” for the words “male” and “feminine” in all policies and practices linked to title IX.

The district must also deliver a memorandum to its schools stating that they must give access to the bathrooms which “protect the privacy, dignity and safety of students and are comparable to each sex”. It is also necessary to declare that compliance with title IX guarantees that girls cannot be discriminated against in any program or educational activity.

As part of the Trump administration, federal officials have sought to target school districts for policies allowing students to use bathrooms or participate in sports teams that correspond to their gender identity.

The president signed a decree in February to prevent transgender girls from participating in sports teams who do not correspond to their biological gender.

Earlier this week, the Republicans of the Chamber presented legislation to prohibit transgender girls from bathrooms or sports teams or toilets that align with their gender identity and not their biological sex.
