A Federal District Court wrongly prevented the administration of President Donald Trump from temporarily retaining billions of dollars in climatic subsidies, a federal court of appeal ruled on Tuesday.

The Washington district court, DC, has granted an injunction preventing the Trump administration from retaining $ 16 billion in climatic subsidies. The Tuesday decision of the DC Circuit Court concludes that the lower court has exceeded its authority by doing so and that the Environmental Protection Agency de Trump (EPA) was acting in accordance with its role to provide “appropriate monitoring” of the distribution of funds.

“We conclude that the district court has abused its discretion in the issuance of the injunction. The beneficiaries are not likely to succeed on the merits because their complaints are essentially contractual, and therefore the jurisdiction is exclusively before the court of federal complaints”, therefore wrote Judge Neomi Rao.

“And although the district court competent on the constitutional complaint of the beneficiaries, this complaint is without merit. In addition, the actions strongly promote the government, which, on behalf of the public, must ensure the appropriate surveillance and management of this fund of several billion dollars,” continued opinion.

The case concerns EPA subsidies worth 16 billion dollars granted under the previous administration to five non -profit organizations to promote the reduction of greenhouse gas emissions. Non -profit organizations included the Climate United Fund, the Coalition for Green Capital, Power Forwing Communities, Inc., Inclusiv, Inc. and Justice Climate Fund, Inc.

When Trump took office, the new EPA has examined the program and sought to reduce the flow of funds. The five non -profit organizations then continued and the district court granted them an injunction.

Judge Rao wrote that the files show that a month before Trump takes up his duties, the EPA modified the grant agreements “to make more difficult for the government to terminate the subsidies”.

Opinion also highlights the statements of an EPA employee who said that after Trump’s electoral victory, EPA under President Joe Biden “simply tried to withdraw money as quickly as possible.”

“The employee compared the situation to” throw the gold bars of the Titanic “,” wrote Rao.

It was after this moment that Trump’s EPA examined the subsidy program and sought to kill him.

“It’s fantastic to see that reason prevails in the justice system,” an EPA spokesman said on Tuesday. “EPA has the duty to be an exceptional intendant of taxpayers’ dollars. The administrator Zeldin has canceled these subsidies due to well-documented concerns about auto-dalton and conflicts of interest, unqualified recipients and intentionally reduced monitoring of the agency.

The Climate United Fund responded to the decision shortly after its transmission, CEO Beth Bafford condemning the result.

“Although we are disappointed by the decision of the panel, we hold firmly on the bottom of our case: the EPA has turned and limited the funds which were legally Obliged and spent. This is another obstacle in our struggle to reduce energy costs for those who need it most while creating jobs for workers, but we will continue to shop for communities across the country who benefit from clean, abundant and affordable energy. This is not the end of our way, “wrote Bafford.

Tuesday’s decision allows non -profit organizations to appeal the decision. The other four organizations did not immediately respond to requests for comments.

The cuts were only a small part of Trump’s wider efforts to slow down public spending through the executive power. In July, EPA announced its intention to reduce its workforce by 23% and close its research and development office.

“Under the direction of President Trump, the EPA examined our operations closely to ensure that the agency is better equipped than ever to deliver our main mission to protect human health and the environment while fueling the American return,” said the EPA administrator Lee Zeldin said in a July press release.
