Jack Smith responds to the ethical investigation into his two proceedings against Trump

Former special lawyer Jack Smith replied on Tuesday through his lawyers for a news that a government watchdog had opened an investigation into his two proceedings against President Donald Trump, calling the baseless investigation.
Smith’s lawyers in Covington & Burling wrote in a letter obtained by Fox News at the Office of Special Advice (CSO) that the predicate for his investigation was “imaginary and unfounded” and that Smith followed all the rules and principles of the Ministry of Justice in his work.
“The actions of Mr. Smith as a special council were in accordance with the decisions of a prosecutor who devoted his career to follow the facts and the law, without fear or favor and regardless of political consequences, not because of them,” wrote his lawyers.

The OSC is an independent agency unrelated to the DoJ or special advice, such as Smith, which worked in the department.
The CSO, which operates as a guard dog, manages the complaints of government’s denouncing people and investigates the violations of the Federal employees’ trap law. It can impose administrative sanctions for reprehensible acts, including fines or termination of government work. Fox News confirmed this month that the CSO was investigating Smith under the Hatch Act, which prohibits certain government employees from engaging in political campaign during work.
The USC survey intervened after senator Tom Cotton, R-Ark., Asked in a letter to the CSO that she examines the cases of Smith seeking to accelerate Trump’s prosecution.
“Many Smith’s legal actions seem to have no justification, except for an attempt to affect the results of the 2024 elections – of shareholders who violate federal law,” Cotton wrote.

Smith spent about two years investigating and continuing Trump during the Biden administration. He brought two accusation against Trump, one alleging that he had violated the Espionage Act in poorly managing national defense information and another alleging that he had tried to overthrow the 2020 elections. Smith rejected both cases after Trump won the 2024 elections, a decision that aligned the DOJ’s long -standing policy concerning the pursuit of presidents.
Smith’s lawyers have written that the actions that Cotton cited in his letter, in particular by asking the courts to move the procedure and give him permission to file longer memories, were “trivial”, the standard for a prosecutor and subject to the approval of the court.
“This investigation is based on a partisan complaint which suggests that the ordinary functioning of the criminal justice system should be disrupted by the whims of a political competition,” wrote the lawyers of Smith.

The letter was sent to the US trade representative Jamieson Greer, who is the head of action of the special advice office while Trump’s candidate for the role faces roadblocks for confirmation of the Senate.
Lawyers asked Greer to contact them directly before taking other measures to investigate Smith so that its conclusions, if necessary, can be “fully informed by the file”.
