Cruz accuses Biden Admin of using autopen to violate the rules of constitutional grace

First on Fox: A Senate republican accused former President Joe Biden and senior officials of the administration “demolished” the constitutional railing for the stands using an automatic.

Senator Ted Cruz, R-Texas, wrote in a letter to the Attorney General Pam Bondi, which was first obtained by Fox News Digital, that there is a list of “basic constitutional requirements” which must be respected for the pardons and the granting of the Clémence, and that the use by the administration of an autopen probably faced the Clemence.

During the decreasing months of its presidency, the Biden administration commissioned the sentences of around 1,500 prisoners and forgiven 39 others in December. Cruz, who is a member of the Senate Judicial Committee and president of the Federal Courts’ Sub-Comeding, Surveillance, Action of Agencies and Federal Rights, proposed to provide jumped assistance in current surveys on the alleged abuse of the Autopen administration.

He said that the clemencances had been published “on the basis of general criteria rather than evaluations on a case -by -case basis, and at least some were signed using a signature of Biden of the time of the president of the time.”

“These main constitutional requirements, considerations and expectations have been demolished in the last months of the Biden administration for the partisan and personal motivations of President Biden, his family and his senior officials,” said Cruz.

Cruz noted that the presidential forgiveness authority granted under Article II, article 2 of the Constitution requires a chain of police custody: there must be an uninterrupted line from the president to a granted forgiveness, he said.

“All the persons involved in the process – government officials claiming to deliver a forgiveness, the person to whom they are granted, legal leaders and the application of the law, and especially the Americans – should have absolute confidence that a forgiveness has been granted in the explicit direction of the president,” said Cruz.

But the recent reports and the ongoing surveys of the congress have raised doubts as to whether Biden explicitly directed the avalanche of the stands towards the end of its presidency.

Cruz’s letter occurs in the heels of an Axios report that discovered emails that showed that Biden officials raised concerns about how the president’s team decided to do certain pardons and the frequent use of the autopen.

Cruz said the emails have shown that the Blanche de Biden house “had implemented a process that separated the president from the officials responsible for the signing of grace in his name.”

“They could not know if they did it in the direction of the president, either on a case-by-case basis or in criterion,” he said.

He argued that the doubts raised by recent reports and current surveys of the Ministry of Justice have risked a “constitutional crisis in which the other branches and the American people cannot have the faith that the forgiveness of article 2 of the president was legitimately deployed”.

“If the integrity of the leniency process was broken by Biden officials, so that the relevant measures have not been taken towards the president, the status of forgiveness and switches would be at least in doubt, and those involved in the approval and use of autopen, should be held responsible,” said Cruz.
