Bolsonaro placed under house arrest in the middle of the Brazilian elections overturning probe

On Monday, the Supreme Court of Brazil ordered the former president Jair Bolsonaro to be put into residential resistance in the midst of a legal proceedings in progress for his alleged attempt to overthrow the results of the presidential election of 2022.

The case has seized the nation since its creation in 2023 and intensified an international examination, especially since it takes place under the authority of a Supreme Court recently sanctioned by the Trump administration in the United States.

Judge Alexandre de Moraes, who oversees the case, accused Bolsonaro, 70, of having violated restrictions imposed by the court.

According to the decision, reported for the first time by the Associated Press, Bolsonaro used a demonstration on Sunday in Rio de Janeiro to publicly address the supporters using a mobile phone belonging to one of his three sons, who are all legislators.

The brief message of Bolsonaro, “Hello, Copacabana, good afternoon my Brazil, a hug to everyone, it is for our freedom”, was considered a violation of its liberation conditions.

The Bolsonaro legal team announced its intention to appeal, arguing that the declaration was symbolic, not criminal and did not justify the additional restrictions.

International repercussions

Political issues have now extended far beyond Brazil. The case triggered President Trump, a long -standing ally of Bolsonaro, who linked the American prices newly imposed on Brazilian imports that he called a “witch hunt”. His remarks have still stretched the already delicate diplomatic relationship between the two nations.

In a detailed statement on X, the office of the American State Department of Affairs of the Western Hemisphere condemned the actions of the Brazilian court, writing: “Putting even more restrictions on the ability of Jair Bolsonaro to defend itself in public is not a public service. That Bolsonaro speaking!”

The office also warned that the people involved in what it described as “sanctioned behavior” would be held responsible.

The declaration marked a strong escalation, in particular because it followed closely on the sanctions imposed by the Department of the US Treasury, under the administration of Trump, against the judge of Moraes. He was appointed “human rights aggressor sanctioned by the United States” and accused of armed the judiciary to silence political opponents.

Treasury secretary Scott Bessent accused Moraes of having led an illegal repression:

“Alexandre de Moraes has taken on himself to be a judge and jury in an illegal witch hunt against us and the Brazilian citizens and companies. He is responsible for an oppressive campaign of censorship, arbitrary detentions and politicized proceedings, including those against former president Jair Bolsonaro”.

These sanctions were imposed under executive decree 13818, published during Trump’s first mandate in 2017. The order declared a national emergency concerning global abuse of human rights and corruption and has expanded to the global law on the human rights rights of Magnitsky adopted in 2016. The American government is imposing financial and travel sanctions on the accumulated foreign officials of human rights.

Despite increasing international pressure, the Brazilian government has not yet published an official response.

Details of the case

Brazilian prosecutors allege that Bolsonaro directed a coordinated effort to delegitimize and, ultimately, the results of the 2022 elections, in particular by planning violent acts and even an alleged conspiracy of assassination targeting President Luiz to Ácio Lula Da Silva and the Moraes judge. Bolsonaro lost the election with a narrow margin.

A panel of judges of the Supreme Court accepted the accusations in March, finally ordering Bolsonaro to undergo his trial. The residual decision on Monday is based on previous restrictions: an ankle monitor, a nightcare-currency and a travel ban while keeping the former confined president in Brasília despite his deep political roots in Rio de Janeiro.

A former army captain and a deeply polarizing figure, Bolsonaro is now joining a short but substantial list of former Brazilian presidents arrested since the country’s return to democracy in 1985, a system he frequently criticized and linked to the military dictatorship which he once congratulated.

The Moraes judge, defending the court’s decision, wrote: “The judiciary will not allow himself to make fun. Justice also applies to everyone. A defendant who knowingly violates the precautionary measures, in particular for the second time – to face legal consequences.”
