Maurene Comey continues Doj for an “illegal” shot, request for reintegration

Maurene Comey, a long -standing American prosecutor who helped file a complaint against Jeffrey Epstein and Ghislaine Maxwell, continued the Trump administration Monday on his brutal shot from the Ministry of Justice.
Comey had served the American lawyer’s office for the South New York district since 2015 before his oust earlier this year. She called on her illegal dismissal, “politically motivated” and argued that this came largely from the fact that her father is the former director of the FBI, James Comey.
In Monday’s trial, Comey lawyers said that his dismissal had violated the “multiple provisions” of the law on public service reform – a law designed to protect government employees, including career federal prosecutors – as well as the first and fifth amendments of the American Constitution.
“The politically motivated termination of Ms Comey – ostensibly under” Article II of the Constitution ” – upsets the principles of the foundation of our system of democracy and justice”, explained his lawyers, describing his withdrawal as “illegal and unconstitutional”.

“The defendants did not provide any explanation to put an end to Ms. Comey,” said her lawyers. “In truth, there is no legitimate explanation. On the contrary, the defendants dismissed Ms. Comey only or substantially because her father is the former director of the FBI James B. Comey, or because of her affiliation and her perceived political beliefs, or both.”
The trial requests that Comey be reinstated in the South District of New York, where lawyers noted that his work has won several prices, promotions and internal recognition, including a recent performance examination calling for “pending” work.
He also cites the protections offered to federal career prosecutors, in particular the prior notification and the capacity to contest a withdrawal.
In the years which followed the participation in SDNY in 2015, her lawyers said that she had been responsible for pursuing some of the most publicized cases in the department – including criminal cases against Epstein, Maxwell and others. More recently, in May, she led the accusation against Sean “Diddy” Combs.

Comey had been invited by the American prosecutor’s office to lead a major public corruption case “one day before his dismissal, said the trial, stressing what his lawyers call the abrupt nature of his dismissal.
She was informed of her termination the next day in a note by e-mail. The email has not listed the cause or reason for referral, according to the trial, although it is mentioned of “Article II” or the powers of the Commander-in-Chief.
American lawyer Jay Clayton did not respond to Comey when she pressed her to obtain information on her shot, according to the trial. Instead, he said, “All I can say is that it came from Washington. I can’t tell you anything else.”
“No other explanation has ever been provided to Ms. Comey concerning the reason for her dismissal,” said her lawyers. “The defendants did not have the legal power to terminate the Federal Service without adhering to the statutory protections which were offered to him.”
They argued that this distinction should be considered as meaning that Comey’s termination is “ultra vires”, or beyond the scope of its authority – therefore “without force or effect”.
“The executive power cannot use article II to cancel the congress and withdraw career officials for perceived disloyalty,” they added. “Such an act violates the fundamental separation of the powers of the Constitution. It also violates the Declaration of Rights, depriving Ms. Comey of protection under the first and fifth amendments.”
The Ministry of Justice refused to comment on the trial, which appoints the Department, the Attorney General Pamela Bondi, the OPM and the President’s Executive Office as defendants, among others.
This comes in the midst of a dispute of several years and high level between President Donald Trump and former director of the FBI James Comey, whom Trump dismissed during his first mandate of the White House in 2017, about five years after his 10 -year term.

In the years following the departure of Comey, the two continued to be strongly disagreed. Comey became a critic of Trump franc, both in public and in his memoirs, “higher loyalty”. Comey returned to the president’s retirement earlier this year after having published what was considered by Trump’s allies as a cryptic publication on online social networks; He denied knowledge of his true meaning.
Trump, for his part, continued to assault Comey and probe his mandate to the FBI. Earlier this year, the FBI confirmed that he had launched criminal investigations on Comey and the former CIA director John Brennan for having allegedly made false declarations in the Congress.
The details of the investigation were not immediately clear, and in the months following the FBI announcement in July, there was little information shared with the public on the nature or the status of the probes.
The young Comey was dismissed about a week after the announcement of the surveys – a detail that his lawyers highlighted in the trial, which seeks his reintegration and his file.

In a farewell email sent to colleagues, Maurene Comey wrote: “If a career prosecutor can be dismissed without reason, fear can infiltrate the decisions of those who remain.”
“Don’t let it happen,” she said.
