Abbott asks the Supreme Texas Court to dismiss the DEM legislator who fled the state

The Governor of Texas, Greg Abbott, and the Attorney General of Texas, Ken Paxton, this week deposited duel petitions at the Supreme Court of the State seeking this week to punish dozens of brilliant Democrats of the Quorum who fled the State to block the passage of a new map of the congression of next year.

Abbott’s petition, tabled late Tuesday evening, alleges that the representative Gene Wu, the president of the Democratic Caucus and his 49 Democratic colleagues violated their “affirmative constitutional obligation” by leaving Texas at the end of last week to prevent the state from adopting the new Congress card.

“The representative WU has openly renounced these constitutional mandates by fleeing the state of Texas to break the quorum, obstruct the legislative procedures and paralyze the Chamber of Representatives of Texas,” said Abbott.

Paxton, for his part, said that he would make judicial orders on Friday August 8 to all the Democrats who were not returned to the House and “arise” before the end of the speaker’s deadline.

Under the Constitution of the State, two thirds of the legislators in the Chamber must be present so that the organization leads business.

It is by taking into account this rule that democratic legislators fled the state in cities such as Chicago, New York and Boston – out of reach of the authorities of Texas and Abbott.

But the newly drawn card of Texas – a rare and mid -December attempt to redistrict – strongly promotes Republicans, and would create five additional state districts.

“The President and the Governor of Texas essentially sparked a kind of” arms race “in Gerrymandering,” said Bruce Spiva, main vice-president of the Legal Center campaign, in Fox News Digital in an interview.

This “also leaves other states that have already adopted reforms to go back in order to try to answer or retaliate,” he said.

California Governor Gavin Newsom threatened earlier this week to dismantle the state independent redistribution commission if Texas passes with his new card.

“The proposal that we advance with the Legislative Assembly has a trigger only if they advance, to dismantle the protocols which are well established,” said Newsom at a press conference, describing the effort as the fight against “fire with fire”.

Spiva, vice-president of the CLC, said that the fight highlights the importance of national legislation to protect against the efforts of Gerrymandering support.

“There is national legislation which has been introduced in previous congresses … which would essentially require independent redistribution commissions everywhere,” he said.

Legislative efforts have been designed specifically to protect itself from situations like today, he said, in which some states have essentially disarmed partisan redistribution cards “and adopted a fair system, while another state says:” Well, hey, it’s great, which leaves me open to Gerrymandering The Heck out of my card! “”

“Never knowledge, a president has never explicitly called a state to redistany in the middle of the decade in order to maximize the advantage for his party,” added Spiva.

Wu has rejected the characterization by Abbott of the Democrats raising.

“Deptering to the governor a quorum was not an abandonment of my office, it was an accomplishment of my oath,” he said on social networks.

At a press conference on Monday, New York Governor Kathy Hochul underlined the extent of redistribution efforts and promised to explore “each option” to redraw state lines.

“We are at war,” said Hochul, speaking alongside the Texas Democrats who fled in his state.

“And that’s why the gloves are turned off – and I say:” Bring it. “”
