Texas Porn Site Age Verification Law considered as constitutional by the Supreme Court

On Friday, the United States Supreme Court confirmed a Texas law demanding that pornography websites check the age of visitors to protect minors from sexually explicit online content.

The judges judged 6-3 according to which to oblige adults in Texas to verify their age does not violate the freedom of expression of the first amendment, noting that at least 21 other states imposed regulations similar to sexual documents which could be harmful to minors online.

Texas and other states prohibit the distribution of sexually explicit content to children in brick and mortar stores, but online content remains largely unregulated.

Legislators of the Star Solitaire state have promulgated a bill requiring certain commercial websites which publish sexually explicit content to verify the ages of those who enter the site, which the judges have supported as constitutional, noting at least 21 other states have imposed regulations similar to sexual documents which could be harmful to minors.

Those who visit sexually explicit websites will have to use the identification issued by the government or a “commercially reasonable method which is based on public or private transactional data”.

Sites can verify themselves or via a third-party service.

If the owners of websites knowingly violate the law, the Supreme Court has judged that the Attorney General of Texas can continue and collect a civil sanction of up to $ 10,000 per day that the site does not comply.

They can also perceive an additional penalty of up to $ 250,000 if minors accessed the sexual equipment due to the violation.

The judges wrote in their opinion that Internet access has radically changed since 1999, when only two in five American households had a computer.

In 2024, 95% of American teenagers had access to a smartphone, with 93% reporting frequent use of the Internet.

In a dissident opinion, judge Elena Kagan argued that the discourse which is obscene for minors is often not obscene for adults.

“Thus, adults have the constitutional right to see the same speech as a state can prohibit for children,” wrote Kagan. “And it is a reality of life – and also of the law – that adults and children do not live in hermetically sealed boxes. By preventing children from access to an obscene discourse for children ”, states sometimes take measures preventing adults from seeing it too – however, for adults, it is a constitutionally protected expression.

Pornhub and other pornography giants have stopped service in Texas and in other states where regulations are in place.

VERIFYMY, who provided a submission of experts for the case as part of the association of age verification suppliers, reacted to the decision by saying that Scotu “has erased a key obstacle to a safer internet”.

“This will reassure Texas’s parents on the type of content to which their children can access online and will have a legislative plan so that other states can follow to keep explicit documents in the hands of adults,” wrote Lina Ghazal, Verifymy Head of Regulatory and Public Affairs, in a declaration at Fox News Digital. “Online platforms have been allowed to count on users self-depicting their age for too long, leaving the door ajar for children with spaces that they are not mature enough to navigate.

“Technology already exists to make these checks effectively, while respecting privacy,” continued Ghazal. “Methods such as e-mail estimate or facial age are tools that adult websites can easily implement, with a minimum impact on user experience. What has missed is a clear legislative preceding. … Child safety must now be integrated at the base of each platform.”

Pornhub did not immediately respond to the request for comments from Fox News Digital.
