The lawyers of the Salvadoral Migrant Kilmar Abrego Garcia filed an emergency request on Thursday asking a federal judge to order the return of their client to Maryland and to prevent ice officials from expelling him while his criminal affair in Tennessee continues to play.

In an emergency file, the lawyers of Abrego Garcia urged the American district judge Paula Xinis to order the return of their client to the district of Maryland “immediately after his release of confinement” in the central district of Tennessee, and so that the judge ordered the Trump administration to refrain from moving his client outside the United States, or the district of Maryland, before his criminal Tennessee.

This is the last decision of a one -month legal struggle on the status of the Salvadoral migrant wrongly.

In the file, the lawyers of Abrego Garcia clarified that they were not trying to plead his criminal affair of Tennessee – a distinct case of the Civil affair Xinis treated earlier this year, when she ordered the return of Abrego Garcia du Salvador after being expelled in March in what the officials of Trump called an administrative error.

The deportation of the march of Abrego Garcia launched a judicial struggle for one month to ensure its release and return to American soil, despite an order from the Federal Court and a decision of the Supreme Court requiring that the administration “facilitates” its return. The government finally respected after months of delay and threats from a federal judge in Maryland to continue a procedure of potential contempt.

On his return, he was immediately placed in police custody for alleged federal crimes resulting from a traffic stop in 2022 – causing a wave of questions When the investigation And the unraveling of a large jury, which charged it on May 21, 2025, would have taken place.

The lawyers of Abrego Garcia told Xinis on Thursday that their request “simply aims to ensure that when Abrego Garcia is released from criminal guard, he returns and stays inside, this district (other than going to Tennessee as needed), until the largest ordinance in this court.”

Their remarks come just a few days after a federal magistrate judge of Tennessee ordered the awaiting trial of Abrego Garcia in his criminal affair.

American magistrate judge Barbara Holmes said in his order on Sunday that the government had not proven his case during an accusation hearing earlier this month that Garcia Garcia was a “serious risk” to flee or hinder justice if he were to be released for trial for criminal accusations.

This is also part of a one -month judicial struggle for the status of Abrego Garcia after its march deportation to El Salvador, and the compliance of the government with the judicial orders to return it.

The lawyers of Abrego Garcia asked Xinis earlier this month imposing sanctions on the Trump administration for what they have argued that the “flagrant” and “repeated” civil obligations of the administration, urging the court to force the TRUP administration to comply with the production of requests for information, which they say that the administration is incorrect, as well as to “investigate the scale”.

Meanwhile, lawyers for the Trump administration urged the court to reject the civil affair, arguing that it is now theoretical since Abrego Garcia is back on American soil.

Xinis has not yet ruled on one or the other motion. However, his judicial struggle of month in Maryland, and now Tenneee, have become a national flash point in the wider fight During President Donald Trump’s hard immigration policies during his second term of the White House.

The Trump administration has repeatedly promised that Garcia Garcia would be taken into detention of ice, if it was released from the federal guard in Tennessee. This fact was underlined Thursday by the legal team of Abrego Garcia while they urge Xinis Thursday to take urgent measures to keep it in the United States and in the district of Maryland.

“If this court does not act quickly, then the government is likely to divert Abrego Garcia in a place away from Maryland,” said lawyers in their emergency file.
