Newsom claims a partial victory despite the court authorized Trump’s custody control

Governor Gavin Newsom said in an official statement that it is disappointed with the decision of the ninth court circuit to allow President Trump to maintain control of the California National Guard, but praising an aspect of the court’s decision as a victory.

Writing on X early Friday morning, the Democratic governor proclaimed that Trump is “not a king and not above the law”.

“The court rightly rejected Trump’s assertion that he can do whatever he wants with the National Guard and not having to explain a court. The president is not a king and is not above the law. We will advance our challenge to the authoritarian use of President Trump of American military soldiers against the citizens,” he said in a press statement later.

The court rejected Trump’s statements That he can federalize the California National Guard at will while avoiding judicial control, noted the governor.

“The ninth circuit rejected Trump’s sweeping that he can federalize the National Guard for any reason and avoid a legal examination, even if it has remained an order from the Emergency District Court. This is an essential control of the presidential surpassing and confirmation that the president is not above the law,” said the Newsom press office.

The Newsom office said that Newsom and Prosecutor General Rob Bonta remain determined to hold the president responsible for the use of soldiers as application of national law – the actions, they argued, were in violation of federal law.

Although Newsom claims that the decision is a victory, there is always an in progress conflict, because the unanimous decision of the ninth Circuit Court of Appeals allowed President Trump on Thursday to keep control of National Guard troops Deployed in Los Angeles earlier this month to stifle the riots during demonstrations against American immigration and the application of customs (ICE).

In the file, the court said they thought the president had made a legal decision.

Even if the president did not inform the governor before deploying the National Guard, as required by the law, the court cited that Newsom did not have the veto of the president’s order.
