The judge blocks the deployment of the Trump National Guard while the White House exploded the decision

The White House castigated a federal judge who temporarily blocked the Trump administration twice from sending the national guard troops to Oregon in October, saying that President Donald Trump “an undisputed authority” to deploy troops in Portland in the midst of in progress immigration protests.

US District Judge Karin Immergut made a decision late Sunday Sunday, preventing the Trump administration from sending California National Guard troops to Oregon – or any other state while Trump advances his quest to deploy troops in major American cities to fight crime and to monitor immigrant and customs application (ICE).

White House press secretary Karoline Leavitt discredited the decision of Immergut on Monday and said that the Trump administration appealed.

“I think that his opinion is not attached to reality and in the law,” Leavitt told journalists during a White House press briefing. “The president uses his authority as commander -in -chief, American code 12 406, which clearly stipulates that the president has the right to call the National Guard and in the cases he judges that he is appropriate.

Earlier Monday, the deputy chief of staff of the White House, Stephen Miller, said that Immergut, one named by Trump, did not have the power to prevent the president from sending troops to Oregon, and paraded the decision as one of the most “obvious” orders he ever seen.

“A judge of the district court has no conceivable authority, to restrict the president and the commander -in -chief of the sending of members of the American army to defend federal life and the property,” said Miller in a position on Monday. “Today’s judicial decision is one of the most blatant and thunderous violations of the constitutional order that we have ever seen – and is still the last example of incessant efforts to cancel the elections in 2024 by Fiat.”

“Don’t forget: all of this is to prevent the abolition of illegal foreign intruders in the United States at all costs,” said Miller.

The Sunday’s temporary ban order intervened just a few hours after Trump signed the mobilization of California National Guard troops in Portland, despite the initial Imgergut prohibition order on Saturday, blocking the deployment of Oregon National Guard troops in the city.

“How could the Federalized National Guard of California be directly in violation of the temporary prohibition order that I made yesterday?” IMMERGUT said at a telephone audience on Sunday.

“Do the defendants not simply get around my order?” IMMERGUT said later. “Why is it suitable?”

The Trump administration argued that the deployment of the national guard troops in Portland, Oregon, is necessary to defend ice officers in the middle of current demonstrations in an ice installation there.

Miller previously kept the first immemer restriction order unless the Trump administration to send troops to Portland, Oregon, and said on Saturday that deployment was “an absolute necessity to defend our staff, our laws, our government, public order and the Republic itself”.

Miller’s messages come in the midst of a meticulous exam for denouncing the judges. For example, Democratic representative Daniel Goldman from New York distinguished Miller and “the extreme right” for the “threatening judges” who govern against Trump after a fire broke out in the property of a judge of the South Carolina Circuit Court on Saturday.

Trump’s efforts to deploy national guard troops in American cities arise just after telling the military leaders in September that they could be responsible for neutralizing “the enemy inside” and that the cities led by Democrats where he sends troops could serve as “training ground”.

“We have to use some of these dangerous cities such as training courses for our military guard, the National Guard, but the military,” Trump told the best military leaders in Quantico in Virginia on Tuesday.

The effort is controversial, given that the posse comitatus act of 1878 provides restrictions on the deployment of American troops to enforce domestic law.

National Guard troops are reserve forces which are mobilized in response to state and federal operations, including natural disasters, and are generally supervised by their governments of the respective states. However, Trump controversially deployed the troops of the National Guard of States to respond to immigration riots in June, bypassing the Governor of California Gavin Newsom to send the troops.

Newsom responded to the Imgegut prescription on Sunday evening and said: “We have just won in the courtyard – again.”

“Trump’s abuse of power will not be held,” said Newsom in an article on X.
