Garcia, Durbin repel the jurisdiction labels of the Federal Doj Sanctuary

Illinois Democrats postpone the Trump era’s attacks on state immigration policies, arguing that the statutes confirm the Constitution, support public security and leave the federal authorities free to do their job.

“These policies are in accordance with the law, maintain local autonomy, stimulate local economies, concentrate the resources for applying the law on the function of local needs and promoted effective police strategies that promote confidence between the police and the communities they serve”, reads a letter from the representative Jesus Garcia and Senator Richard Durbin.

The letter noted how the Ministry of Justice called Illinois and Chicago as “sanctuary jurisdictions” in its last public announcements, and refuted the assertion that the State or the city commits a sort of violation.

The letter, supported by several Democrats from Illinois, underlined the law on state trust – signed by Gov then. Bruce Rauner, a Republican. Critics have long qualified him as a sanctuary style policy to prevent police from keeping people on immigration status alone.

“Likewise, the welcoming city ordinance of Chicago prevents the arrest or detention of an individual only on the basis of a violation of civil immigration and prevents local officials from giving ice access to detainees unless this access is based on a legitimate objective of application of the law which is not an application of civil immigration,” wrote Garcia and Durbin.

“In accordance with Illinois Trust Act, the welcoming order of the city does not prevent ice from engaging in immigration application activities,” they said, adding that Cook’s county – which includes Chicago – has similar policies.

They affirmed, citing a precedent of justice, that the authorities of the state or local holding people without immigration violates the fourth amendment – unlike federal detention.

Fox News Digital also contacted the DHS to comment but did not hear at the time of the press.
