The judge puts an injunction at the national level on the order of citizenship of the birth of Trump

A federal judge appointed by Biden published a national injunction on the order of citizenship of the right to the birth of President Donald Trump, arguing that the directive should be found in violation of the Constitution.
The American district judge Deborah L. Boardman issued his opinion on Thursday after accepting to certify a collective appeal of the Casa immigration rights group.
“The court concludes that the complainants have shown that they were entitled to a preliminary injunction at the class level. The complainants have established that they are likely to succeed in the substance of their constitutional affirmation because the executive decree contradicts the clear language of the direction of the fourteenth amendment and conflicts with the binding supreme court,” wrote the board of directors in its decision.
“The complainants have also shown that the representatives of the class and the members will undergo irreparable damage – the refusal of citizenship – without injunctive recovery. Finally, the complainants have established that the balance of actions and the public interest weigh in favor of a preliminary injunction,” she added. “The government will not be injured by an injunction which maintains the status quo of the citizenship of the birth law, and the complainants will be injured if the decree is not prohibited while waiting for the outcome of this trial.”

Boardman is now the fourth judge to issue a block on the death since a decision of the Supreme Court in June, according to the Washington Post.

Trump’s order, signed on the first day of his second White House term, ordered all American government agencies to refuse to issue citizenship documents to children born of illegal immigrants, or who do not have at least one parent who is an American citizen of legal permanent resident.

He was almost immediately blocked by the lower courts, before finally heading towards the Supreme Court, who examined the case in May.
Decision 6-3 of the High Court focused closely on the authority of the ability of the lower courts to issue injunctions on a national level and did not legality of the image of the order of Trump, which served as a legal pretext for the case.

In the decision, the judges said that the complainants requesting a national compensation should file their affairs as a collective appeal – causing a wave of action by ACLU, CASA and other defense groups for immigrants who have changed their deposits.
