The legal advisor of the NGO Monitor, Anne Herzberg, said that even if he was not surprising that Albanese published a scathing report on Israel, because she did so much in the past, this last report was unique.

“I think the difference is now that this report explicitly approves the adoption of BDS – Boycotter, Disinvestment and sanctions against Israel – in a very manifest way,” Herzberg told Fox News Digital. She added that even if Albanian is an independent investigator, the report could be interpreted as the UN supporting the BDS movement against Israel.

In response to a request for digital comments from Fox News, the office of the High Commissioner of the United Nations Human Rights said that “experts in special procedures”, like the Albanians, operate on a voluntary basis “, do not receive wages and are not UN staff.

“While the United Nations Human Rights Office acts as a secretariat for special procedures, experts are used in their individual quality and are independent of any government or organization, including OHCHR and UN,” the OHCHR media team told Fox News Digital. “All the opinions or opinions presented are only those of the author and do not necessarily represent those of the UN or the OHCH.”

Herzog told Fox News Digital that not only Albanian has exceeded the limits of its role, but the United Nations Human Rights Council (HRC) because it does not have the power to issue sanctions, which the report recommends.

“The United Nations Human Rights Council, where it presented its report, and it is under which it works, does not have the power of the United Nations Charter to issue sanctions,” said Herzog. “And therefore not only has she exceeded her mandate as rapporteur, the United Nations Human Rights Council by approving this, without approving the report, but allowing this report to be published.”

Herzog said he had seen “threatening and harassing” letters that Albanian sent to companies and NGOs “essentially threatening them to be included on his boycott list and claiming that they were accomplices of international crimes such as genocide, apartheid, blocking of self -determination or Palestinians.”

Israel turns tables on a UN official claiming the “genocide” in Gaza with basic issues

The United Nations guiding principles on companies and human rights are a voluntary code on which companies can connect as a commitment to be aware of the way their operations take place and their customers are treated. Herzog argued that the Albanian “weapons this positive and pluralist voluntary framework” and that it hurts it, which makes it a “restrictive punitive framework”.

“Not only does it deform international law, but it deforms this framework of UNGP, and I suspect that if this type of activity is gaining in purchase or that other people are starting to follow its traces, but it will be responsible for essentially destroying the whole field of human affairs and rights.”

Albanese presented its CDH report Thursday, just two days after the United States called for its withdrawal on its “anti-Semitism and anti-Israeli bias”.

In the report, Albanian affirms that companies have helped Israel in “its current genocidal campaign in Gaza”. She repeated this statement to the CDH on Thursday, accusing Israel of being responsible for one of the most cruel genocides in modern history “. She also accused Israel of using war in Gaza as a testing ground for new weapons “to exterminate a people without restraint”.

The Israeli ambassador to the UN in Geneva Daniel Méron, who was not present in the meeting of the CDH, told Fox News Digital only through his Albanese report “was readily putting global efforts to promote the propaganda of terrorism”.

“This report, like all the others by this rapporteur, is riddled with inflammatory rhetoric and is legally baseless,” said Méron to Fox News Digital. “Her obsession with demonizing Israel is clear in the story she pushes.”

Albanese did not answer questions from Fox News Digital or Request for comments on time for publication.
